    It's interesting that you say that CJ because that makes me wonder where the line would be drawn (insurance and litigation wise) between an injury from games room equipment and an injury from home gym type equipment.

    Home gym and games room equipment aren't a million miles away from a pool. We all have a pool, along with the relevant safety notices, alarms, disclaimers, etc. so at what point do things change from being OK to being a liability?

    I ask because at some point I did want to go the way of a home gym type set-up but having read this thread it does sound like a complete minefield.

    The gamesroom was relative to a room where we have the pool tables not gym equipment, thats one area I wouldn't go, there again I dont know what the implications would be with regards to weights and such like, I dont see how a treadmill and an exercise bike would be a liability though.

    The only thing I miss when in Florida is being able to use my treadmill everyday and running/power walking outside in August is not very motivating!![msncry]

    It wont be that motivating doing it in a garage neither, the vast majority of games rooms in villas are in the garage,the garages are not A/C it would be like exercising in the greenhouse.

    [/quote]I understand completely what you're saying but, if there is this type of equipment provided in a villa, then you'd probably be in the very small minority as someone who's qualified to use it. The rest of the guests would be tempted and probably know absolutely nothing about it and risk injury. As a trained personal trainer you will obviously completely understand this situation.

    I honestly don't think there are many Florida home owners out there who could firstly afford the type of liability insurance costs involved here or secondly afford the almost inevitable lawsuit which would undoubtedly follow if someone injured themselves.

    That's quite an interesting point you make there Blott, and it got me thinking ...

    If we wanted to offer this as a service to our guests we could look at taking out some kind of 'guest' membership at a local gym which would have better facilities too than we could put in our own homes. The flip side would be how many guests would drive to a local gym whilst on holiday? If, like me, you answer 'not many' then this kind of suggests that there isn't a huge demand for this kind of kit. Unless it's in the villa for convenience. But we can't do that because of insurance.

    So it gets like a chicken and egg? We can't put it in the villa because of insurance, but if guests really want the service we could provide it. But guests probably don't really want it ... unless it's in the villa. Arrrrgh. [msneek][msneek]

    Personally i would love a gym in the garage, but understand the insurance bit, so to be honest
    like last year I will go for a run in the late afternoon / evening when its cooler. Then jump
    straight in the pool after a nice cold beer then im refreshed for the rest of the night

    No-one's telling you what you can and can't put in your own Florida home but you would have to be prepared to bear the risk. As a home owner you have responsibility for guest safety in your home. That's why there are so many rules and regulations about this asssociated with licensing a villa. Whether you could even get the insurance coverage is a moot point, particularly as the equipment would be unsupervised by someone qualified to do so. Lawsuits in the US can run into very high figures and would probably be out of range for any but the super rich to fund out of their own pocket (who won't need to rent out their home anyway!).

    In the last five years, I think I've heard of only a handful of guests who have asked about gym facilities. They've been given info about professional facilities with supervision so that they can arrange what suits them the best.

    I've looked into this and it definitely does carry heavy insurance liabilities. If anyone got hurt using the equipment, then I would be 100% liable, even if they were at fault for not using it correctly.

    I wanted to provide a boat for my guests to use, so that they could fish in the centre of the lake. Again, I can't do this because no company will insure the risk, at least not at a rate that makes it even remotely viable.

    It seems that we can have swimming pools and games rooms as these are covered by our normal liability insurance. Games rooms generally only have games in them that don't require the guest to have any kind of specialist knowledge in order to play.

    It's a great shame, but there doesn't seem to be any way around it at the moment.

    am i right in thinking that the lawsuit would fall under american law, even if the owner and renter were british and the matter was reported to a brit solicitor?[8D]

    A gym is somewhere where you choose to go ( its nothing like having to clean your teeth or shower as routine, washing is a nessecity, exercising is what you choose to do and working out with equipment is a whole different ball game)

    Why on earth should we, as owners, pay a liability insurance, and trust me it would be a large amount, just so that the odd few guests want to work out (once again by choice) no disrespect here, but we provide beautiful homes and generally provide extra entertainment in the form of gamesrooms, playstations etc..for the whole family, not just one individual.

    There are many complexes out there with the gyms for you to use as well as the public gyms that are dotted around.

    This is not a selfish point of view but with all due respect Lucy, not everyone is a personal trainer and it only takes a child to " explore" and fiddle around with any equipment, and if there was a problem I am sure we would be liable despite having a disclaimer.
