    refused entry

    hi all i live in kissimmee florida ,i am on a E-visa, my son gary aplied for a B1 holiday visa in london and was told that he did not need one as he could use the waiver program so he came to the USA to spend a few weeks with me butat the port of entry he was refuised entry and put back on the plane to the UK he was told that he needed a visa so he went back to london and they told him that he is now band from the USA how is this fair so please carfull if anyone trys the same

    OMG Derek thats a terrible thing to have happened to your son. What reason did they give for his refusal of entry and ban?

    they told him that because he had gone for a visa and used the waiver that it was fraud,he has never ever been any trouble with the police or anything

    Why did he apply for a visa if he was just going to the US for a visit? Do they believe he intended to stay?

    he was giong to stay with us while we settled in by looking after his bother and sister and then his friend was coming over and they were going to tour the grand canyon etc, he had a return ticket as well but they did not belive him

    Unfortuantely it seems like the actions of the minority have spoiled it for others once again. Although your sons case was legit others aren't and they make the assumption that your son is trying to enter by the back door and settle here.

    It wouldnt hurt to put all the sctions on paper and write to the Embassy to clarfiy the situation. With the Visa waiver you do waive your right to any explanation as to why they have refused you entry. I have wondered in the past how it would work as I know people have applied for the Visa and been turned down as they were told it wasn't necessary (did your son have his paperwork on him as to why it was turned down (too late now but if he could show it wasn't because of ineligibilty as he didnt intend to stay longer than 90 days that would have shown them. On screen they probably just have a "Visa refused" tyoe thing.

    If it's any consolation our friend was denied entry a few years ago as they thought he might be going to work (which he wasnt but staying with relatives for 3 months, he applied for a Visa on return which was denied and told he could not apply for another year, he did that and it was approved and he has been back many times since with no trouble. Apparently it is quite common for them to refuse the first time (almost as atap on the wrist for being naughty even though they hadnt done anything and the next aplication approved.

    I forgot to also say sorry to hear the predicament your son is in. I'm sure you were all looking forward to a great family Christmas apart from anything else and that has now been spoiled for you all. I hope he manages to resolve it soon. As I said if you keep all the relevant paperwork and then rite to Embassy they may be able to clarify or make sure it doesnt happen to someone else.

    Thank you all for your advice and thoughts
    i have wrote to the embassy the president the immigration ,homeland ,border patrol, and orlando airport the white house ,the governor of Florida and all i get is the same old run around ,i even went to the head office and had a interview at the immigration office in Orlando still no good ,it not there department they told me ,even the US president said that he feels for me but nothing good came from it ,it seems like it all depend on the mood of the passport control person at port of entry on the day you attempt to come through , you never know what will happen
    how’s the UK ? as it looks like i will come back, had enough of this place and there mindless games they play

    Ialso forgot to say the reply from the Embassy was that he did not meet the requirements; he has a full time job, money in the bank. Rent a house, has car payment to make, what more do they want he is 23 and now scared for life (sorry to sound so bitter but they really boil my blood)

    It is worth bearing in mind that even if he had obtained a B1 holiday visa, he could still be turned away at immigration if the officer had the same doubts as they obviously had when your son entered on a waiver. The only difference is that he could appeal and see the ground for refused entry.

    As said above, the grounds are pretty obvious. Father on an E visa. Someone with a full time job wanting to spend several weeks with father and then go off and tour. Having a return ticket means nothing - a single is more expensive!

    That is not to say I don't completely sympathise with you and son. A classic 'catch 22' situation!

    what gets me is the Embassy told him to use the waiver,the port of entry told him because he went for a visa they turned him back and to get a visa , so back to the Embassy to get told he is banned
