The problem is, you are looking at the Budget terms and conditions. Agents can (and do) have a seperate set of T&Cs compared to the rental companies themselves.
If ever there is a problem (which there never has been, and we take thousands of orders) then it is the agents T&Cs that come in to play. I agree it is confusing and can be worrying if you go on to the car rental sites directly and read the T&Cs on there, or if you look at their paper T&Cs as they can differ so much.
Another good example, that often worries people, is U-Saves T&Cs regarding under age 25 drivers. If you ask U-Save directly about minimum age they will say 21, and a surcharge for age 21-25. Booking through us the T&Cs are different allowing age 19+ and no surcharge for age 21-24.<blockquote id="quote" class="ffs">quote:Originally posted by Robert5988

Thanks for that Roger, you are confirming precisely the point I was making.
Where I get my cars has exactly the same condition as yourself e.g. allows the second driver to be anyone.
However nowhere on the Budget terms and conditions does it say that the "second driver can be anyone" - it stipulates spouse!
The important point being that there is no provision(certainly on fast track) for the second driver to be named.
So, as said before, if I go with a party of 5 people; all of them could drive and if there is a problem, the one driving could say he was the sole second driver.
More worrying is that the terms and conditions specifically state the second driver must be a spouse; and frankly I don't feel happy about letting someone, who is not my spouse, drive; unless they have been cleared and named by Budget; for, as you say, "strictly speaking" they should be.
In fact the terms and conditions(I have a copy in front of me) state that unless any other driver is 'specifically authorized' they cannot drive the car.
All drivers on Alamo/Dollar/Avis are named and have to initial the agreement.
My agent, like you, has yet to 'figure this out' and is in contact with Budget on the matter.[/quote]
