Make a claim for compensation under the EEC Regulation and I'll bet my home that Virgin will say it's not their fault. The is a precedent from the BA situation earlier this year. BA were successful in rejecting claims for delays and cancellations by passengers in a similar situation.
I've flown BA over 30 times this year and have been distinctly unimpressed with their customer service.
