How can he not admit it was his fault, when you were standing still?

I was parked in Tesco's car park about a year ago. Was at the back of the car putting the bags in the boot and felt my own car go backwards into my legs and nearly knocked me down. I had a right up and downer with him and took his insurance details. He at first said he never touched the car, then admitted that he might have just clipped it.

glad both you and your daughter are ok Sally, your health and wellbeing are more important than anything else[grouphug]

if the car park has no cctv of the incident then i'm sure the asda manager would give you a statement to support your insurance and stop you paying out that excess

    take care[grouphug]

How can it be anyone elses fault but the other driver's? You weren't even in the driving seat! It was his car that moved.

Did you get names of any witnesses? I agree with the others about seeing your doctor, also should you have reported it to the police?

Just so glad to hear you're both O.K apart from feeling understandably shaken.

There owner of the car wasn't even there he was in asda doing his shopping. When he came out and the manager spoke to him he was like 'well there is no damage to my car'. He looked at his car which was where he had left it as people pushed it back over, a window was open as there was a dog left in the car, and they put it into gear to stop it rolling away again. He just shrugged his shoulders about the whole thing and carried on putting his shopping in the car. There was an elderly man who saw it and said he couldn't help me as he had just had heart surgery but he did go back into the shop to ask them to put it out that the owner of the car should return to his car, all this time Jess and I were holding the car off us. I asked to man for his details as a witness but he just walked away[msnmad], didn't want to get involved, well thanks for that[msnsad].

Customer services must have altered the manager as that is when he came out with 2 trolly boys and a passing man who pushed the car back, so they didn't actually see it happen.

I am so mad that through no fault of mine I am landed with a excess of £325 or a damaged car[msnmad]. Asda are going to ring tomorrow to say if they have it on CCTV, but it is a shot in the dark as they said the cameras move all the time. Oh and guess who he insures with, yes asda[msnscared]. Looks like it may be my word against his.

Been onto insurance company and discovered our excess is £325[msnoo], that will teach us to check the policy more closely in future. The only way we can claim that from them is for them to admit liability, which I very much doubt they will.

Been in touch with Asda as they said before I left that they may have it on CCTV, they are going to check for me.[/quote]You can still claim, if you are in the right just threaten to sue for loss of excess.
