Hi,

See discussion link below.

It seems the 6 month rule was abandoned a couple of years ago and you can travel right up to the expiry date now.

Our passports run out January 14th and March 21st 2010 and we go to Florida October this year, so i do not have to renew them for this trip is that what you are saying.

Now that's a difficult one....
If you're travelling under the visa waver scheme, you're allowed entry for 90 days. thus your Jan. passport would have run out before your visa. We've had the situation that, even though we had return tickets, the Homeland Security guy insisted on ammending our visas so that we had to leave US before our passports expired - took him ages.
You might be well advised to renew the Jan. passport - Passport agency will add any remaining months on your 'old' passport to new one, which will then be valid in excess of 10 years, so you don't loose out.

I don't follow this answer. If the OP is travelling under the visa waiver scheme, then there is no visa to run out. And where do the 90 days come in? Although the OP didn't mention it, I doubt very much they are staying for 90 days.

There is no need for anyone to be confused - if you leave the USA before your passport expires then you have absolutely no issues.

Cut from US gov. webpage:-
[The Visa Waiver Program (VWP) enables nationals of certain countries to travel to the United States for tourism or business [visitor (B) visa purposes] for stays of 90 days or less without obtaining a visa.]

That isn't in dispute.

However the person going in Oct this year will have to leave the USA by Jan 14 2010. So if they go on say Oct 31st then they can only stay for 75 days on their Visa waiver on that passport.
