Just got this update through as i registerd some months back ...

Dear Potential Class Member:

This notification is being sent to you regarding a proposed settlement that has been reached in a class action lawsuit. The lawsuit alleges that British Airways Plc and Virgin Atlantic Airways, Ltd. unlawfully conspired to fix prices of fuel surcharges imposed on “long-haul” passenger fares. Long-haul flights include most flights between the U.K. and non-E.U. destinations, including flights to and from the United States. All flights on Virgin Atlantic qualify as long-haul. Tickets must have been purchased between 11 August 2004 and 23 March 2006.

Attached to this email are copies of the court-ordered Notice and a Claim Form that you can file to apply to participate in the Settlement. Members of the Class who file a valid claim will be paid 33.3% of the passenger fuel surcharge they paid on qualifying coupons. Refund payments will range between £4 and £20 per passenger per round-trip ticket purchased in the U.K. and between $7 and $34 per passenger per round-trip ticket purchased in the U.S.

For more information about the terms of the proposed Settlement, please read the attached legal notice. You may also visit www.airpassengerrefund.co.uk. If you would prefer to file a Claim Form electronically, there is an on-line Claim process available on the website.

This isn't anything to do with 'Air Passenger Duty' which is something very different - although just as much of a rip-off.

Is that the link to claim for Virgin flights booked during the price fixing period? Have tried it but the page said there was a problem with the website security. Continue on was not recommended. Not being technically minded I just closed the page down. Where do you go to register your claim please?

I've got Vista on my laptop but when we tried it on the other computer it worked fine. Apparently have until 2012 to claim - hopefully that doesn't mean they are going to take that long to sort out! Has anybody heard if any claims have been dealt with yet or any sort of timescale?

Now I've just received exactly the same email as posted above and I haven't registered for anything to do with this previously.

I'm not sure that the site is genuine or not? Looks either like spam or a scam?

I have looked at their website, they do give a lot of information etc, but what do they get out of claiming the refund, rather than going direct to the airline, do they get a percentage of the claim.

This does appear to be genuine because the same information (containing the same e-mail address) is available as a direct link from the BA site. How people are selected to receive this e-mail remains a bit of a mystery though.

After reading this thread yesterday, I received two of those emails, both to different email addresses and both from different people. I hovered my mouse over the links and strange looking info came up. As it happens, I also had an email reply from that email address as I had sent them an enquiry from the email contact form on the official website, reached hrough the Virgin Atlantic site.

I think best be safe than sorry and do not link through these unsolicited emails. Better to reach them through the airline sites.

I got the warning on my computer also when i tried the link.

It may be down to which kind of virus software you us.

I use AVG and it checks for phishing sites and untrusted security certificates.

I would be very carefull giving out any info on such a site.

I too wondered about the links, but it was sent to both my and my husbands email accounts, which are registered on Virgins airmiles accounts. I cannot remember which flight we had for those years. Is there a way of checking?

I've just completed our claim form on-line and got the dates of travel from the security stickers that they put on your passport (and which I never bother to peel off). As you only need to give the dates of travel and the departure and arrival airports, hopefully they will be able to find us (not holding my breath though!!). The hardest bit for us was remembering whether we flew from Gatwick or Heathrow!!

I just filled in the Virgin frequent flyer number option and it should give them all the flights you have taken using those numbers.

I will look at all the immigration stamps in my passport, for the dates. I will know if they are Virgin or BA anyway

They did ask how we would like the payment so to be on the safe side we put cheque rather than giving bank details for direct payment into our account. Not that we're cynical....

I looked at the stickes and there is one date that comes between the stated dates, but I think we also flew out the year before with Virgin. Steph, where did you fill in the frequent flyer option please? Like some of the others the link given will not open for me.

OK quick question as i don't seem to be able to get an answer on this. I have two lots of flights to claim for where we have used our Flying Club details: - Novemeber 2004 (This was for 5 People) and February 2006 (This was for 9 People, wonder what that was for!!) We paid for all the people on both occasions using our Credit/Debit Cards (Not that that will make any difference!) and was wondering how do we claim back for all the people on both trips? Essentially we have paid for 14 Return trips in that period but obviously not all tickets are in our name?


Just to add i have looked on Kaye's and my Frequent Flyer accounts and there are transactions totalling 10000 for 2004 and 18000 for 2006 coming off our accounts. I looked on the Air Passenger Refunds website FAQ's and it has this: -

'30. I purchased many tickets for various members of my family. Should I file a claim form for each person?

No. If you purchased all of the tickets for the family, as the purchaser of the tickets you are the claimant and you should file one claim form with the information listed for each ticket.'

Now i take it as i will be submitting the claim using our Flying Club numbers that all the details will be available from there?

If you go through the website link and if you know the names of all your party and travel dates/flight nos you can put all the claim together under one reference.
