i know this an unreal situation , my lovely son may get a criminal record ..... pls any advice welcome....

There are lots and lots of threads on this subject if you do a search and lots of ways of interpreting the regulations.

If you look solely at the Visa Waiver form, he needs to have been arrested/convicted for a crime of moral turpitude to be ineligible. Whilst crimes of moral turpitude are not defined, they are serious offences.

However if you look at the US Embassy website for UK, any arrest, even if there is no conviction, renders you ineligible for entry under a waiver.

Look on the US Embassy for some other countries and it doesn’t state the same.

Minor traffic offences are exempt.

Don’t bother ringing the US Embassy(at £1.50 a min) as they will tell you to come for interview.

May and has got are two different things so look on the bright side until it actually happens.

There are lots of threads about this in this section of the forum with plenty of advice if the worst happens.
